3 Day Notices
Orlando Property Manager Dennis Burgess (Hampton & Hampton Management & Leasing, Inc.) discusses one of the unpleasant yet necessary duties of a professional property manager- serving “3 Day Notices” upon tenants who have not yet paid the current month’s rent.
Governed by Florida Statutes 83.56, these notices are the very first steps in what could ultimately be an evictions process. As with any journey or process, it’s often the very first steps that are the most important ones- and that’s surely the case here.
Tenants have THREE FULL BUSINESS DAYS within which to pay their outstanding balance (including late fees) or the landlord MAY commence eviction proceedings.
Does every 3 Day Notice result ultimately result in an eviction? Hardly. Yet it’s that POSSIBILITY of the tenants not paying in the next few days that requires us to serve the notices and lay the ground work just in case.
Look at 3 Day Notices as your car’s spare tire- it’s best to have one whenever you take a long road trip. If all goes well, it’s unnecessary- but if you have a problem, you’re surely glad you brought it along with you.
